Motorcyclist was recklessly cut-off by a motor vehicle attempting to pass him causing him to lose control of his motorcycle and sustain a closed head injury and multiple fractures of the thoracic spine. The insurance of the motor vehicle was involved unreasonably refused to pay Plaintiff’s PIP benefits – opting instead to proceed with trial.
Mud track incident where a forklift was located dangerously close to the racetrack. In 2016, Moss & Colella helped client settle an auto-accident case in the amount of $500,000. Unfortunately, the same Client experienced another traumatic car accident in two years later – this time with her mentally disabled daughter was a passenger in the vehicle.
Negligent installation of glass cabinets by landlord causing head and face injuries to 22-year-old woman resulting in permanent facial scarring.
Plaintiff was broad sided by a commercial vehicle resulting in a traumatic brain injury and shoulder SLAP tear with paralabral cyst requiring surgery.
Driver was rear-ended by commercial vehicle causing disc herniations in her lumbar and thoracic spine as well as a torn labrum in her shoulder.
Client used the staircase at a rental home when the hand railing detached from the wall causing her to fall and suffer multiple subdural hematomas requiring a craniotomy procedure to drain fluid from the brain. Discovery revealed Landlord had notice of defective handrail and negligently repaired it.
Injured driver suffered soft tissue issues and aggravation of pre existing conditions. The allowable expenses included home modifications, attendant care, and household service. The settlement was $145,000.
National restaurant chain allowed a foreign object to be served in a meal, causing a patron to choke when swallowing the object. The patron suffered a neck injury from retching to extricate the object and required surgery months later. Settlement $199,500
A man was injured by an intoxicated patron in a local tavern. The bar was held liable for serving the patron alcohol while he showed visible signs of intoxication and was making homophobic slurs. The patron prevailed on his claims under the Michigan Dram Shop Act,”which makes it illegal to serve a “visibly intoxicated person.” The settlement:
