An unarmed woman was wrongfully shot multiple times inside of her vehicle by the Dearborn Police Department causing her death.

Pedestrian was struck by a motor vehicle resulting in a traumatic brain injury and fractured skull.

3rd Party Auto – $600,000

Woman rear-ended on Woodward Avenue by a semi-tractor trailer vehicle resulting in traumatic brain Injury along with cervical and lumbar disc herniations.

Pedestrian MACP – $280,000

Pedestrian was struck by a motor vehicle and the driver fled the scene. Client suffered a fractured skull, cervical disc herniation, and multiple lumbar and thoracic disc bulges. Because neither the Client nor any relatives in his household had insurance, Client filed a claim with the Michigan Assigned Claims Plan.

Motorcycle/3rd Party Auto – $450,000

Motorcyclist was rear-ended by a motor vehicle and catapulted from his bike causing client to suffer disc herniations, disc bulges, and spinal fusion surgery.

Motorcycle/PIP – $606,000

Motorcyclist was recklessly cut-off by a motor vehicle attempting to pass him causing him to lose control of his motorcycle and sustain a closed head injury and multiple fractures of the thoracic spine. The insurance of the motor vehicle was involved unreasonably refused to pay Plaintiff’s PIP benefits – opting instead to proceed with trial.

General Negligence/Mud Track – $228,276

Mud track incident where a forklift was located dangerously close to the racetrack. Client collided with the negligently located forklift and suffered catastrophic injuries, including:  left leg below the knee amputation, right lower leg fracture requiring open reduction internal fixation surgery, and right bicep tendon injury.  Claims defended under a reservation of rights.

PIP Benefits – $398,000

Driver collided with semi-truck resulting in a closed head injury, disc herniations, and a shoulder tendon tear requiring surgery. Insurance carriers denied Attendant Care Benefits and Wage Loss.

Multiple Auto / 3rd Party & PIP- $333,500

In 2016, Moss & Colella helped client settle an auto-accident case in the amount of $500,000. Unfortunately, the same Client experienced another traumatic car accident in two years later – this time with her mentally disabled daughter was a passenger in the vehicle.

Landlord Tenant/Negligence – $307,000

Negligent installation of glass cabinets by landlord causing head and face injuries to 22-year-old woman resulting in permanent facial scarring.

PIP & 3rd Party Auto – $295,000

Plaintiff was broad sided by a commercial vehicle resulting in a traumatic brain injury and shoulder SLAP tear with paralabral cyst requiring surgery.

3rd Party Auto – $185,000

Driver was rear-ended by commercial vehicle causing disc herniations in her lumbar and thoracic spine as well as a torn labrum in her shoulder.

Premise Liability / Landlord / Tenant Negligence – $175,000

Client used the staircase at a rental home when the hand railing detached from the wall causing her to fall and suffer multiple subdural hematomas requiring a craniotomy procedure to drain fluid from the brain. Discovery revealed Landlord had notice of defective handrail and negligently repaired it.

  • Minor passenger involved in roll-over accident sustains multiple orthopedic injuries and traumatic brain injury. Auto insurance carrier refuses to pay medical bills and Attendant Care services. Settlement $350,000.
  • Pedestrian struck while crossing an unlit street sustained a leg fracture requiring open reduction internal fixation surgery. Denial of Attendant Care benefits by insurance carrier. Settlement $169,868.71
  • Detroit police officer struck broadside by another vehicle while pursuing a fleeing felon, resulting in multiple rib fractures and post-traumatic stress disorder (PTSD). Settlement $115,000.
  • Driver rear ends another vehicle on the highway, resulting in traumatic brain injury. Claim for attendant care benefits denied by insurance carrier. Settlement $139,000.
  • 71 year-old woman crossing a two- lane highway outside of the crosswalk walks directly into the path of a truck trailer pulling a pontoon boat. Investigating officer finds no fault on behalf of the driver. Woman suffers traumatic brain injury. Settlement $300,000.

  • Plaintiff suffered a mild closed head Injury. Settlement $150,000.

  • Apartment complex held liable for tenant’s child who placed a lit sparkler on a 6-year-old, resulting in severe third-degree burns. Settlement $200,000.
  • Elderly woman attempting to enter retail chain store encounters malfunctioning automatic door that strikes her, causing her to fall and fracture her femur. Settlement $210,000.
  • Plaintiff slipped and fell inside an auto plant, resulting in fractured elbow. Settlement $145,000.
  • Renter burned in her bathtub claims landlord’s maintenance staff negligently adjusted the hot water tank for the woman’s apartment. Settlement $130,000.

National restaurant chain allowed a foreign object to be served in a meal, causing a patron to choke when swallowing the object. The patron suffered a neck injury from retching to extricate the object and required surgery months later. Settlement $199,500

Bar Liability for Patron Assault

A man was injured by an intoxicated patron in a local tavern. The bar was held liable for serving the patron alcohol while he showed visible signs of intoxication and was making homophobic slurs. The patron prevailed on his claims under the Michigan Dram Shop Act,”which makes it illegal to serve a “visibly intoxicated person.” The settlement:
